PROCEDURAL SAFEGUARDS NOTICE ROAD MAP

This is a document you receive at every IEP meeting you attend to inform you of your parental rights and you usually have to sign a paper acknowledging that you received it.

​

Parents have the right:

  • To a fair and accurate evaluation of your child

  • To refuse to consent

  • To receive an Independent Educational Evaluation (IEE)

  • To participate

  • To mediate a dispute

  • To keep your child in the same program while waiting for mediation or due process to be completed.

  • The right for a hearing if you disagree with the IEP the LEA has offered for your child.

  • To see your child's educational records and maintain privacy

  • To file a complaint against your LEA

  • Special protections in school discipline

  • Removing your child from special education programs

  • To be aware of your rights if your child attends a private school

New in Fall of 2018

The Bureau of Special Education brought forth regulatory changes to the PA State Board of Education in regard to the archaic terminology of mental retardation. The Special Education regulations, known as Chapter 14, eliminated the terminology in all regulatory and state promulgated documents and the terminology is replaced with the language of ‘intellectual disability’. This includes changing the state promulgated forms and documents, such as the Evaluation Report, IEP, and Procedural Safeguard notices to parents. The new forms were available for download for LEAs on 9/3/18.
